Terms of Use

Version 2026-10-13

Downloader is an Android app developed and operated by Wambesha LLC, a New Mexico (USA) limited liability company (NM SOS ID 0008057749), 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA. We operate from Mombasa, Kenya, under the registered business name WABESHA TECH (BN-DBCPG73G), Anna House, Tononoka, Mombasa, Kenya. In this document "we", "us" and "our" mean Wambesha LLC.

These terms are the agreement between you and Wambesha LLC for your use of the Downloader app. By using the app you agree to them. If you do not agree, do not use the app.

1. What the app is

Downloader is a catalogue of films and series. For a title it shows a list of references and hands the one you choose to another app on your device.

The Downloader app itself stores and serves no files. A reference it shows is one of two kinds:

The app does not play films or series and does not download them. The app you open a reference with does that. The Content Policy explains this in full.

The app also has a community, where members post and reply, and a list where you save titles.

You do not pay to use the app. Advertising is how the Downloader is meant to be paid for; the Privacy Policy says what that means for your data.

2. Who may use it

You must be at least 13 years old. If the law of your country sets a higher age for agreeing to terms like these, you need the permission of a parent or guardian until you reach it.

You can use most of the app without an account. Some features, such as posting in the community, need one. Keep your sign-in details to yourself: you are responsible for what is done with your account.

3. What you may use it for

Use the app only for content you are legally entitled to get: works in the public domain, works released under an open licence, and material you own or have permission to use. You are responsible for following the laws and licences that apply to you. A reference appearing in the app is not a statement by us that you have a right to the work it points to.

You must not try to break, overload or get around the technical limits of the app or of the services behind it, and you must not use it to harm other people.

4. References to other sources

References to other public sources are collected automatically. They may be wrong, incomplete or no longer available. We do not control those sources and we are not responsible for what they hold. A transfer from one of them happens between your device and that source, in the app you chose.

5. Rules for what you post

You are responsible for what you post in the community. We do not tolerate, and we remove:

The Community Guidelines and the Content Policy shown in the community set out the rules in full, what happens when they are broken and how to appeal. We may remove content, limit posting or close an account that breaks them. You can report any post or reply.

6. Your content

You keep the rights to what you post. You give us permission to store it, to show it to other people in the service and to translate it for readers, for as long as it stays posted.

7. Copyright

If you believe that something reachable through the app infringes your copyright, the Content Policy explains how to send a notice, what a notice must contain, how to answer a notice about your own material, and our rule for people who infringe repeatedly. We act on a valid notice within 24 hours of receiving it.

8. Leaving, and closing accounts

You may stop using the app and delete your account at any time. The page called Delete your account explains how. When your account is deleted, the posts and replies you wrote in the community stay, with your name removed. The Privacy Policy lists everything else that stays, and for how long. We may suspend or close an account that breaks these terms or the law.

9. The app is provided as it is

We work to keep the app available and correct, but we provide it "as is" and "as available". We do not promise that it will always work, that a reference is accurate, or that a source it points to is safe or lawful. Nothing in these terms takes away a right that the law of your country gives you as a consumer and that cannot be given up by agreement.

10. Limits on our liability

To the extent the law allows, Wambesha LLC is not liable for indirect or consequential loss, loss of data or loss of profit arising from your use of the app. Our total liability to you for all claims arising from the app or from these terms is limited to the greater of 100 US dollars and the amount you paid us in the twelve months before the claim.

These limits do not apply to liability that the law does not allow us to limit, such as liability for death or personal injury caused by negligence, for fraud, or for harm caused on purpose or by gross negligence.

11. Your responsibility to us

If someone brings a claim against us because of content you posted unlawfully, or because you used the app in breach of the law, you will compensate us for the reasonable loss and cost which that claim causes us. This applies only to the extent the claim results from your own unlawful act.

12. Governing law and disputes

These terms are governed by the laws of the State of New Mexico, USA. Disputes are heard by the state or federal courts located in Bernalillo County, New Mexico.

If you are a consumer living in the European Union, the United Kingdom or Kenya, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country.

These terms contain no arbitration clause.

14. Changes

We may change these terms. For a material change we tell you at least 30 days before it takes effect, by e-mail or by a notice in the service, and we ask you to accept the new version before you carry on using your account. If you do not accept it, you may stop using the service and delete your account. Each published version carries a version label, and we record which version you accepted.

15. Language

This document is written in English. Translations are provided for convenience. If a translation differs from the English text, the English text governs, unless the law of the country where you live says otherwise.
