Content Policy
Downloader is an Android app developed and operated by Wambesha LLC, a New Mexico (USA) limited liability company (NM SOS ID 0008057749), 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA. We operate from Mombasa, Kenya, under the registered business name WABESHA TECH (BN-DBCPG73G), Anna House, Tononoka, Mombasa, Kenya. In this document "we", "us" and "our" mean Wambesha LLC.
This policy explains where the films and series you find in the Downloader app come from, what you may use the app for, and how a rights-holder can ask us to act.
1. What the app does and does not do
The Downloader app itself stores and serves no files. It shows a catalogue of films and series and, for a title, a list of references. When you choose a reference, the app hands it to another app on your device that you choose. The Downloader app does not play a film or a series, and it does not download one.
2. Where a reference leads
A reference shown in the app is one of two kinds.
- A catalogue file. The file is stored and served by a catalogue service operated by Wambesha LLC.
- A reference to another public source. This is a reference, such as a BitTorrent magnet reference to a public swarm, to material that Wambesha LLC does not host, store or control.
References to other public sources are collected automatically from places that are already publicly reachable. They may be inaccurate, incomplete or no longer available. Showing one is not a claim of ownership, an endorsement or a grant of any right to the work it points to, and a transfer from such a source happens between your device and that source, in the app you chose.
3. What you may use the app for
Use the Downloader only for content you are legally entitled to get: works in the public domain, works released under an open licence, and material you own or have permission to use. You are responsible for following the laws and licences that apply to you where you live.
4. If you hold the rights to a work
We respect copyright. We act on a valid notice within 24 hours of receiving it.
You can send a notice in either of these ways:
- In the app: on the screen that lists the references for a title, choose to report the title and pick the copyright reason. You do not need an account. You are asked for your name and e-mail address, and you receive a reference for your notice.
- By e-mail to rights@downloder.app.
Postal address for notices: Wambesha LLC, Attn: Copyright notices, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA.
5. What a notice must contain
- your physical or electronic signature (typing your full name is enough)
- the work you say is being infringed
- the title and the reference in the app that you want us to act on, with enough detail for us to find it
- your name, postal address, telephone number and e-mail address
- a statement that you believe in good faith that the use you complain of is not authorised by the rights-holder, its agent or the law
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the rights-holder or are authorised to act for the rights-holder
6. What we do with a notice
A person on our team reads every notice. When a notice is valid we act on it within 24 hours of receiving it: we remove the reference from the app or disable access to it.
7. If your material was removed by mistake
If material of yours was removed or disabled because of a notice and you believe that was a mistake or a case of mistaken identity, you may send a counter-notice to rights@downloder.app. It must contain:
- your physical or electronic signature
- what was removed or disabled, and where it appeared before
- a statement under penalty of perjury that you believe in good faith it was removed or disabled by mistake or misidentification
- your name, postal address and telephone number
- a statement that you accept the jurisdiction of the federal district court for your address or, if you live outside the United States, of any court in which Wambesha LLC may be found, and that you will accept service of process from the person who sent the notice
We pass a valid counter-notice to the person who sent the notice, and we may restore the material as section 512(g) of the United States Copyright Act allows.
8. People who infringe repeatedly
We close the accounts of members who repeatedly post infringing content.
9. Contact
Rights-holders: rights@downloder.app. Everything else: support@downloder.app.
10. Changes
We may change this document. The version in force is the one we publish, and each published version carries a version label.
11. Language
This document is written in English. Translations are provided for convenience. If a translation differs from the English text, the English text governs, unless the law of the country where you live says otherwise.
